Low, Ball & Lynch’s experienced team of construction group attorneys specializes in the representation of developers, general contractors, design professionals and subcontractors in all areas of construction law. The group has experience in site developments, residential developments, commercial buildings, hospitals, government buildings, apartments, college dormitories, and gymnasiums. Our attorneys counsel our construction industry clients in all aspects of construction-related litigation, including design/construction defects; delay, disruption and acceleration; earth movement; jobsite injuries, land subsidence, mold, administrative law proceedings, and insurance coverage.

At Low, Ball & Lynch, our aim is to aggressively represent our clients in a cost-effective manner. This includes the drafting and operating of successful joint defense agreements and the effective use of alternative dispute resolution, where appropriate. Our attorneys have extensive experience in handling defect litigation involving single-family detached homes, common area developments, apartments, commercial structures, and land subsidence. Our practice group also has extensive experience in the handling of bodily injury and property damage claims, including mold. We strive to work closely with our clients and their insurers to develop the most effective and efficient litigation plan for the defense of these actions.

Our attorneys also have extensive trial and arbitration experience in both state and federal courts, and before the American Arbitration Association and other arbitration forums.

Our practice group regularly provides preventive advice and training seminars to our clients around the country concerning new and existing laws which impact their business and the claims handling process. Our training seminars provide the most updated information to our clients so that they can more effectively manage their litigation.

We have handled many cases for different carriers involving construction defect. This includes Arch, Scottsdale Insurance, Western Heritage, Century Surety, American Safety Insurance, Chartis, Clarendon, Zurich, St. Paul Travelers, Fulcrum, QBE, Mid-Continent, Illinois Union, NARS, Sequoia, Montpellier, First Specialties, Marquel, First Mercury and Golden Bear Insurance. We also work extensively with third-party administrators; for example, Midland Claims, Gallagher Bassett, Lancers, Specialty Claims Management, NovoPro as well as Engle Martin. Finally, our construction practice group has extensive experience in the area of coverage and regularly advises our clients on insurance law and contractual indemnity issues. Our focus in this area allows us to more effectively manage our cases by spreading the risk and significantly reducing the cost of litigation to all parties involved
